TERMS AND CONDITIONS OF USE
ECART PAY
The following Terms and Conditions (hereinafter the “Terms”) outline the conditions of use for the services you, as a User, provide on the digital platform at https://pay.ecart.com (hereinafter “Website” and/or “Platform”) and any content available by or through this Website. These Terms govern the use of the ECART PAY website, S.A.P.I. DE C.V. (hereinafter “We” and/or “ECART PAY”).
ECART PAY is located at Belisario Domínguez, number 2470, floor 3, Colonia Obispado, Monterrey, Nuevo León, C.P. 64060.
By using the Website, you agree to accept and comply with the Terms regarding your use of the Website. If you do not agree with these Terms, please do not use the ECART PAY Website. If you have any questions regarding them, please send an email to support@ecartpay.com
ECART PAY reserves the right to make changes to the Terms regarding the Website at any time without prior notice, which will be published on said site, making it your obligation to stay informed of these Terms.
DEFINITIONS
The following definitions, which can be applied in singular or plural form, are detailed below:
Activation: Process by which the User gains access to the production account to use ECART PAY Services.
API: The Application Programming Interface of ECART PAY and any tools made available to developers.
Application / App: The software application, Website or any other medium developed, maintained, or operated to interact with the API, the Website, and/or the Services provided by ECART PAY.
Commission: Any charge, regardless of its name or modality, other than interest, that ECART PAY charges the User for the provision of the Services.
Chargeback: Means the dispute(s) that a Cardholder raises with the issuing bank for a charge made to their Card, requesting the return of their money resulting from a good or service.
Contract: These present Terms of ECART PAY in which the conditions applicable to the execution of one or more transactions are established and the Services provided by ECART PAY are regulated, which must be accepted to use the Services.
User Account: The account through which the User is initially identified, which is required so that ECART PAY can provide its Services.
Provisions: The General Provisions Applicable to Disposition Media Networks.
Payment Method: Refers to the Payment Methods that ECART PAY has available for Users, which are: (1) Credit and debit cards, whether national or international (VISA, MasterCard, or American Express); (2) Interbank payments via SPEI (Electronic Interbank Payment System); (3) Cash payments through referenced deposits in available chains; (4) as well as any other Payment Method that is available and enabled in the future through ECART PAY.
Payment Gateways: The different platforms made available that Users with access keys can use to process online payments.
Services: Means the service provided by ECART PAY, which consists of: (1) processing payment requests with Cards through a website or an online platform; (2) acceptance of cash payments through the available chains within the ECART PAY Payment Methods; (3) receiving/accepting interbank payments via SPEI (Electronic Interbank Payment System).
Website and/or Platform: Any of the content available on or through this Website.
Card: Credit cards and debit cards.
Cardholder: The holder of the Card.
Transaction: The operation consisting of processing any payment request with Card for goods and/or services offered by the User through any digital platform, submitting the request for authorization or rejection by the issuer of the Card in question, through ECART PAY.
Fraudulent Transaction: the Transaction that is carried out or attempted without the authorization or consent of the Cardholder, or that is received, processed, and/or carried out without complying with the provisions, procedures, and/or rules established in these Terms or in applicable legislation, or that are illegal, constitute a crime, are sanctioned by applicable legislation, or are prohibited under it.
User: All individuals or entities that acquire the Services of ECART PAY and have a User registration within the Website.
READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING OR USING THE PLATFORM AND THE SERVICES.
ELECTRONIC COMMUNICATIONS
By visiting the ECART PAY Website or sending us emails, you are communicating with ECART PAY electronically and give your consent to receive electronic communications from ECART PAY. ECART PAY will communicate via the email you registered on the Platform.
USE AND RESTRICTIONS OF ECART PAY WEBSITE
We operate our Website so that you can learn about and use our Services. By accessing and using the Platforms, you agree to be legally bound by these Terms. ECART PAY will always have the right to deny, restrict, suspend, condition access and use of the Platforms temporarily or permanently, or to terminate these Terms immediately at its discretion.
To use the Platform, you must register and complete the corresponding form with your personal information accurately, truthfully, and free from any bad faith vices, committing to monitor and modify your personal data when necessary, in addition to verifying your identity.
In the event that the information provided in the registration does not match your identity, you will not be able to continue with the process of contracting the Services.
The relationship between you and us will be the use you make of the Services provided through the Website and/or the digital Platform. By using the Platform, you declare that you act on your own behalf and that the service will be for personal use and never for a third party.
PLATFORM AND RESPONSIBILITIES
We are constantly innovating our Platform and Website to provide you with the best possible experience. Therefore, through these Terms you acknowledge and accept the following:
Updates and improvements
Our platform may change from time to time, as we are constantly innovating. This means that some features may improve, change, or even be temporarily suspended. If at any time we suspend your account, you will not be able to access or consult your information or movements.
Risks of using digital means
When using the app and website, there are risks you should be aware of:
There may be internet outages, delays in SPEI, or problems with third-party services (card issuers, acquirers).
If you use public WiFi networks or insecure devices, you could be at risk of digital attacks.
We always protect your information, but it also depends on you to use the app responsibly.
Your security is key
Your username and password are personal. Do not share them with anyone. We will never ask you for passwords or codes over the phone, email, or messages. If you notice suspicious activities on your account, notify us immediately through the app or our support email.
Use of your web page or medium
If you have your own page integrated with us, we may display and promote it on other platforms of ours or those of our related companies. If you do not want us to do this, you only need to cancel your service with us and stop using the platform.
DESCRIPTION OF THE ECART PAY SERVICE
ECART PAY may provide you with the requested Services through its digital Platform or other integration options, and/or any related or complementary product or service it offers or may offer in the future.
Processing payment requests with Cards. The services of ECART PAY in its payment aggregator mode to process payments via credit, debit, grocery, and/or electronic wallet cards through purchase orders via e-commerce, websites, and mobile applications. The services may also be processed through the Payment Link modality, which consists of collecting through a web link that allows the User's customers to make payments via the ECART PAY Services previously contracted.
Recurring charges. ECART PAY may enable, at the User's request, an additional payment processing mode with Card under the recurring charges scheme. This functionality consists of the prior authorization granted by the Cardholder for the User to make periodic and automatic charges to the same Card, in amounts and frequency agreed upon between the User and the Cardholder. The User agrees to:
Obtain and keep the express and informed consent of the Cardholder for making recurring charges;
Ensure that the Cardholder can revoke such authorization at any time, stopping the charges immediately upon receiving such instruction;
Inform the Cardholder about the charging calendar, the amount to be charged, the cancellation policy, and any other relevant contractual elements;
Comply with the guidelines issued by ECART PAY and the card brands regarding recurring charges. ECART PAY reserves the right to suspend or revoke this functionality in case of detecting chargeback levels, claims, or practices incompatible with these Terms, with applicable provisions or with the guidelines of the Card Brands.
Acceptance of cash payments. Regarding the services that ECART PAY offers to process cash payments in national currency through referenced deposits in available and/or authorized chains.
Interbank payments via SPEI (Electronic Interbank Payment System). The service of receiving payments via SPEI transfer (Electronic Interbank Payment System) through a unique CLABE account that will be assigned to each User who decides to perform any operation by this means.
Payment Gateways with custom keys. ECART PAY may offer you the secondary service of connecting to different “Payment Gateways” where it will provide you access to the Platform to make the connection when they are available, this through the configuration of your system using API credentials to achieve integration of various Platforms. For this intermediary service, ECART PAY will not be responsible for the proper functioning of the platforms of those Payment Gateways.
USER INFORMATION
During the time you are using our Website and/or the Services, you may be asked to provide certain personal information, which ECART PAY guarantees maximum protection for and will only be used for the use of the Platform, in the relationship that you have with us.
We will use location-based information from your mobile device, using GPS technology (“Global Positioning System”), in those locations where such technology is available, so it is necessary to collect, use, transmit, process, and store your geographic data, including, but not limited to, the geographic location of the device as well as information related to your first name, last name, email address, and phone number associated with the device. Thus, you consent to our conducting real-time geolocation to continue with the contracting and/or use of the Services.

ACCOUNT REGISTRATION
If you wish to use our Services, you must register by accepting these Terms. To register, it is mandatory to complete the identification form in all fields with valid data and precise, true personal information.
By registering, you guarantee the truthfulness of the information and assume the commitment to update your personal data when ECART PAY requires it, as necessary.
We reserve the right to request proof and/or additional information to validate and corroborate the provided information, as well as to temporarily or permanently suspend any Users whose data could not be confirmed.
Similarly, ECART PAY, in order to comply with applicable regulations regarding the prevention of money laundering and financing of terrorism (PLD/FT) and its internal policies in this regard, may request certain information and/or documentation for identification, knowledge, and transactional monitoring purposes, which may vary according to your economic activity within the Platform of the Services you use.
We reserve the right to reject a registration request or to cancel or suspend, either temporarily or permanently, an account in the following cases: a) if incongruences or inconsistencies in the provided information are detected; b) if you do not provide or update the required information and/or documentation in a timely manner, without such a decision generating rights to compensation or reparation; c) if the activity you declared is defined as prohibited under these Terms.
You may not register with us if you have or have had sanctions related to any criminal situation, if your name is on blacklists, and/or if you have or have had any relationship with any type of fraud, regardless of whether it has been sanctioned or not.
In general, access to the Website may be free. However, ECART PAY conditions access to certain areas of the Website and the use of all its Services on the prior completion of the User identification registration form.
ECART PAY may make certain Services available whose use may require complementary registrations and/or the satisfaction of certain considerations. In such cases, the registration will be done in the manner expressly indicated in the service itself or in the specific conditions regulating it.
Once the registration process is successfully completed, we will activate the account. The use of your account is personal and non-transferable, so you agree that, at all times, you will be the sole responsible for all movements made in your account and to keep the password secure with which you will access the Platform.
You agree to notify ECART PAY immediately and through the appropriate and reliable means of any unauthorized use of your account, as well as access by unauthorized third parties to the same.
ECART PAY reserves the right to reject any registration request or to cancel a previously accepted registration without being obliged to communicate or explain the reasons for its decision and without generating any rights to compensation or reparation.
You confirm that you have the sufficient and legal capacity to adhere to these Terms.
If you provide false, inaccurate, outdated, and/or incomplete information, or if ECART PAY has reasonable grounds to suspect that you have violated these Terms, ECART PAY has the right to suspend or cancel your account and deny the use, present or future, of the Services or any part thereof.
GENERAL CONDITIONS OF THE SERVICES
ECART PAY and you agree that these Terms aim to establish the conditions of use of the aforementioned Service(s) through all Payment Methods that are available or will be available on the Platform.
By using any of the Services, you assume all the risks involved in operating and conducting activities through websites or the internet.
For processing payment requests with Cards, you agree not to apply any additional charge to your customers for accepting payments with Cards and/or fund credits through your platforms and/or ECART PAY’s Platform.
Availability and timelines for the settlement of your funds
The funds that are credited to your account due to the contracted Services will be available according to the following timelines and conditions:
The amount of the authorized Transactions on a specific operational day and before the cutoff time (10:00 PM), Mexico City time, for VISA and MasterCard Cards will be deposited into your bank account within 2 (two) business days following the authorization of the corresponding transaction.
For Transactions with American Express Cards, they will be deposited within 2 (two) to 3 (three) business days following the authorization of the corresponding transaction.The amount of Transactions via interbank transfers and cash payments received from Monday to Sunday will be deposited on Thursday of the following week.
Hereby, you acknowledge that you are responsible for any amount owed to ECART PAY that derives from the Services, including the execution or processing of Transactions.
Limitations
You accept and acknowledge that ECART PAY may determine a maximum amount for your Transactions, which may vary according to the Payment Method, type of request, and/or at ECART PAY’s discretion and may even be modified at any time, being sufficient for its publication on the Platform.
Additionally, we inform you that financial entities or acquiring banks may set minimum and maximum amounts for certain transactions, which may change from time to time.
Chargebacks
ECART PAY will notify you when there is a Chargeback, in which case you agree to provide ECART PAY, within 5 (five) calendar days following the notification, the information requested regarding the operations and their reversals generated, under the resources and technical means that ECART PAY provides, and you authorize ECART PAY to use this information to support you in refuting said Chargeback.
You acknowledge being informed and authorize ECART PAY to make withholdings on your funds when Chargebacks for Transactions and/or for operations made with bank Cards are received, up to 180 (one hundred eighty) calendar days, when it comes to Cards and/or international Transactions the withholding may be for up to 540 (five hundred forty) calendar days.
Once the corresponding information is received, ECART PAY will deliver the information to the issuing Bank within the timeframe indicated. The issuing Bank will analyze and provide a resolution on the Chargeback within no more than 45 business days after the delivery of the information. The issuing Bank will notify ECART PAY about said resolution, which may be in favor of the Cardholder or in favor of the Commerce (you).
If the resolution was in favor of the Cardholder, ECART PAY will refund the amount of the transaction directly to the Cardholder or through the issuing Bank. If the resolution was in favor of the Commerce, this means it was resolved in your favor, so ECART PAY will release the previously made withholding and the transaction will be settled for you.
It is important to note that the decision on the resolution of the Chargeback depends entirely on the issuing Bank; therefore, ECART PAY is not responsible for the outcome of the chargeback resolution.
In the event that ECART PAY does not receive the requested information or the submission is incomplete, incorrect, deficient, and/or delayed, the withholding made for the amount of the Chargebacks will be deducted from the settlement of your funds.
Without prejudice to what is detailed in this section, it is informed that if you do not have funds to settle, you agree to pay the Chargebacks within 30 (thirty) calendar days following the notification to the bank account that ECART PAY will provide you for this purpose.
ECART PAY reserves the right to withhold for investigation any payments it deems, at its sole discretion, to be or potentially be irregular operations or at risk of Chargeback.
In addition to the preceding paragraph, ECART PAY may retain a certain percentage of the settlement of your funds for a period that could be at least 30 calendar days due to a detected risk, for which case, ECART PAY will provide you with prior notice.
Responsibility for the Funds
The User exempts ECART PAY from all liability for situations that may affect the banking, financial, and/or agents' entities where the funds of the accounts are deposited, as well as for political and economic situations that may arise in the country, which are beyond ECART PAY's control.
In the mentioned cases, Users will not be able to impose any liability on ECART PAY, its affiliates or subsidiaries, controlling and/or controlled companies, nor demand the reimbursement of money or payment for lost profits, due to damages resulting from such situations nor due to unprocessed or rejected payment orders by the system, nor due to suspended or canceled accounts.
You accept and commit to keep ECART PAY harmless from any claims made by a third party regarding the contractual relationships they acquire with you and the payments they make using the Services.
Clarifications
When you do not agree with any movement appearing in the respective Account Statement or in the movement status available on the Platform, you may submit a clarification request to ECART PAY within a timeframe of 30 (thirty) business days from the date the movement occurred.
This clarification request may be made through the help portal of the Platform; the electronic help channels provided by ECART PAY and/or by email support@ecartpay.com
Once your clarification request is received, ECART PAY will be obliged to acknowledge receipt and indicate the attention folio number of your clarification. ECART PAY will have a maximum period of 45 (forty-five) natural days or 180 (one hundred eighty) natural days when dealing with operations made abroad, to provide you with the corresponding opinion, attaching a simple copy of the document or evidence considered for issuing said opinion, as well as a detailed report responding to all facts contained in the request submitted.
If the 30 (thirty) days mentioned in the first paragraph of this section elapse without you having made any clarification, it will be understood that you agree with the operations carried out and that the entries or concepts appearing in your account statements, and those recorded in ECART PAY's accounting will be deemed accepted by you and will have full evidentiary value.
Returns and/or Cancellations
You authorize ECART PAY to decrease the total value of the Transactions to deposit the corresponding amount when returns and/or cancellations occur, and these amounts will be deposited to the Card from which the charge was made. Returns or cancellations can only be made for the total amount charged to the Card.
You are responsible for adequately informing your customers, at the time of the Transaction, of any limitations you may have for accepting the return of goods and, if applicable, you will strive to offer refunds upon receipt of the Transaction made to the Cardholder's account that has charged the Transaction and will strive to provide a receipt for the operation.
ECART PAY will not refund the commissions generated by the Transactions made.
COMMISSIONS FOR THE SERVICE
For the use of the Services, you agree to pay ECART PAY the commission(s) that are generated plus the corresponding value-added tax for each operation and/or Transaction.
You expressly state that you understand and agree to the terms, conditions, amounts, and scope of the commissions you are obligated to cover, in such a way that you expressly authorize us to deduct from any amounts we must deliver to you the amount of the commission (or any other tax or fee that, in accordance with applicable law, must be withheld).
ECART PAY may unilaterally modify the commissions by notifying you 30 (thirty) natural days prior to the date on which they take effect. If you do not agree with such changes, you may terminate the contractual relationship without any liability by notifying at least 10 (ten) days in advance of the date on which the commission change takes effect.
PAYMENT MANAGEMENT SERVICE
Regarding Payment
ECART PAY, if applicable, may provide you with the secondary payment management service according to the instructions you provide us, in order to liquidate your funds on your behalf, using the Platform provided by ECART PAY.
It is agreed that the requests for management or processing of payment requests that you duly complete will be governed by these general Terms.
By completing a payment management request, you grant an irrevocable mandate to ECART PAY to pay, on your behalf, a certain sum of money concerning which the payment management request is completed, on your behalf, subject to the Terms of the payment management service.
ECART PAY will not use the funds for purposes other than those instructed by you.
ECART PAY reserves the right not to process those payment management requests that are incomplete or for which there are discrepancies between the data you provided and the data effectively entered in ECART PAY or because ECART PAY deems it necessary, without needing to justify its decision.
ECART PAY will not verify the cause or obligation that gave rise to the payment instruction, nor the other circumstances related to the payment instruction.
Since ECART PAY is unrelated to the obligation that gave rise to the payment management request, ECART PAY will not be responsible for or verify the causes, amount, or any other circumstances related to that request, as well as regarding the existence, quality, quantity, functioning, status, integrity, or legitimacy of the goods or Services you may have offered, acquired, or disposed of and paid for using ECART PAY.
Payment instructions entered in a payment management request may only be made through the Platform, and no instruction submitted will be processed or deemed valid by any means not related to the Platform.
ECART PAY will not be responsible for orders, instructions, payment management requests, and/or mistaken or incomplete payments caused by the incorrect entry of the information you provide.
ECART PAY will not be responsible nor guarantee compliance with the obligations you have assumed with third parties concerning the payments to be made or collected through the Platform.
PATRIMONIAL MATERIAL
Unless specifically requested, we do not ask for or wish to receive any confidential, secret, or proprietary information, nor any other material from you through the Website, email, or any other means.
Any information, creative work, demonstration, ideas, suggestions, concepts, methods, systems, designs, plans, techniques, or other materials you send us or present (including, but not limited to, those you present or submit to our chat groups, message boards, and/or our blogs, or send us by email) shall be considered non-confidential or secret and may be used by us in any way consistent with the Website.
By submitting or sending us materials, you: I. Represent the legitimacy of the materials presented, that no other person has any rights over them, and that any “moral rights” regarding the presented materials have been waived; II. Grant us or our affiliates, free, unrestricted, worldwide, irrevocable, non-exclusive, and fully transferable rights and licenses, which may be assigned and sublicensed, to use, copy, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, execute, display, and incorporate into other works any of the materials presented in any form, medium, or technology now known or hereafter developed, including promotional and/or commercial purposes.
We cannot be responsible for retaining any material you provide and may delete or destroy any submitted material at any time.
PROPERTY RIGHTS
ECART PAY is the exclusive owner of all rights, title, and interests in and to the Website of all content (including, for example, audio, photographs, illustrations, graphics, other visual media, videos, copies, texts, software), codes, data, and materials thereof, the look and feel, design, and organization of the Website and the compilation of content, codes, data, and materials on it, including, but not limited to, any copyrights, trademark rights, patent rights, database rights, moral rights, sui generis rights, and other intellectual property and proprietary rights thereof.
Your use of the Website does not grant you ownership of any of the content, codes, data, or materials to which you may access on or through the Website.
All software and content on the Website, including; HTML code, texts, animations, images etc., as well as trademarks, trade names, and/or distinguishing signs displayed, are the property of ECART PAY or third parties and are protected by national and international intellectual and industrial property laws.
Any use outside the Website, including reproduction, modification, distribution, transmission, re-publication, arrangement, or representation of any elements thereof, is strictly prohibited unless with the express written consent of ECART PAY.
PROHIBITED USE
Any distribution, publication, or commercial or promotional exploitation of the Website or any of the content, codes, data, or materials on the Website is strictly prohibited unless you have received prior written permission from authorized personnel of ECART PAY, or from any other rights holder.
Unless expressly permitted in these Terms, you may not download, report, expose, publish, copy, reproduce, distribute, transmit, modify, execute, disseminate, transfer, create derivative works from, sell or otherwise exploit any of the content, codes, data, or materials on or available through the Website.
You also agree not to alter, edit, delete, remove, or otherwise change the meaning or appearance of, or change the purpose of any of the content, codes, data, or materials on or available through the Website, including, without limitation, altering or removing any trademark, registered trademark, logo, service mark, or any other proprietary content or notice of proprietary rights.
You recognize that you acquire no ownership rights when downloading any copyright material or through the Website.
If you make any other use of the Platform or of the contents, codes, data, or materials located or available through it, unless as stipulated above, you may violate copyright laws and other laws of the United Mexican States and other countries, as well as other applicable laws and may be subject to legal liability for such unauthorized use.
TRADEMARKS
The trademarks, logos, service marks, registered trademarks (hereinafter “Trademarks”) displayed on the Website or in the content available through the Website are trademarks of ECART PAY, registered, unregistered, and others, and may not be used in connection with products and/or Services that are not related, associated, or sponsored by their rights holders and which may cause confusion to customers or in any way that demeans or discredits their rights holders.
Nothing in this content on the Website should be interpreted as granted, by implication, waiver, or otherwise, any license or right to use any trademark displayed on the Website without the written permission of ECART PAY or third parties that may own such trademark.
The misuse of trademarks displayed on the Website or through or in any of the Services of the Website is strictly prohibited.
NOTIFICATIONS
For the purposes of making timely notifications, ECART PAY designates the contact location stated at the beginning of these Terms. The email provided by you during the registration process on the Website will be used by ECART PAY to make notifications to you from the moment of contracting.
You are obliged to keep your data referenced in this section duly updated for the purposes of notifications.
All notifications made by ECART PAY will be considered validly made if they have been carried out using the correct and precise data, through the aforementioned means.
ECART PAY and its related companies will not be responsible for your actions that originate or relate to information contained in false emails or that appear to come from ECART PAY sent by third parties unrelated to ECART PAY or its related companies; nor will they respond for the damaging consequences of such actions, nor for the circulation of said false emails.
APPLICABLE LAW
By visiting ECART PAY, you agree that the laws of the United Mexican States, regardless of your domicile and conflict of laws, will govern these Terms, as well as any controversy of any kind that may arise between ECART PAY and/or its affiliates or subsidiaries and you.
CONTROVERSIES
Any controversy related in any way to your visit to ECART PAY will be submitted to alternative dispute resolution methods, except that, to the extent that you, in any way, have violated or threatened to violate ECART PAY's intellectual property rights, the latter may seek injunctive or other types of relief before the State or Federal Court in the State of Nuevo León, and you agree to submit to the exclusive jurisdiction of such courts.
POLICIES, MODIFICATION, AND SEVERABILITY OF THE WEBSITE
It is necessary to review our policies published on this Website. These policies will also govern your visit to any Platform in relation to ECART PAY. We reserve the right to make changes to our Website, policies, and these Terms at any time.
If any of the stipulations is found to be invalid, null, or for any reason unenforceable, such condition will be considered separate from the validity and applicability of any of the other conditions.

You agree to receive email campaigns/newsletters in order to provide you with information about promotions, new functionalities, important notices, and general information.

Los siguientes Términos y Condiciones (en adelante los “Términos”), contemplan las condiciones de uso de los servicios tú como Usuario le des a la plataforma digital en https://pay.ecart.com (en adelante “Sitio Web” y/o “Plataforma”) y a cualquiera de los contenidos disponibles por o a través de este Sitio Web. Estos Términos regulan el uso del Sitio Web de ECART PAY, S.A.P.I. DE C.V. (en adelante “Nosotros” y/o “ECART PAY”).

Al usar el Sitio Web, se entenderá que aceptas y estás de acuerdo con los Términos en lo que se refiere a tu uso del Sitio Web. Si no estás conforme con estos Términos, por favor, no hagas uso del Sitio Web de ECART PAY. Si tienes alguna duda respecto a los mismos, por favor, escribe un correo electrónico a support@ecartpay.com
ECART PAY se reserva el derecho de realizar cambios a los Términos respecto al Sitio Web en cualquier momento y sin previo aviso, mismos que serán publicados en dicho sitio, por lo que será tu obligación estar al tanto de dichos Términos.
DEFINICIONES
Se detallan a continuación las siguientes definiciones, las cuales pueden ser aplicadas en forma singular o plural:
Activación: Proceso mediante el cual el Usuario obtiene acceso a la cuenta de producción para utilizar los Servicios de ECART PAY.
API: La Interfaz de Programación de Aplicaciones de ECART PAY y cualquier herramienta puesta a disposición de los desarrolladores.
Aplicación / App: La aplicación de software, el Sitio Web o cualquier otro medio por el que se desarrolle, conserve u opere para interactuar con la API, con el Sitio Web y/o con los Servicios prestados por ECART PAY.
Comisión: Cualquier cargo, independientemente de su denominación o modalidad, diferente al interés, que ECART PAY cobre al Usuario por la prestación de los Servicios.
Contracargo: Significan la(s) disputa(s) que realiza un Tarjetahabiente ante el banco emisor por un cargo realizado a su Tarjeta, solicitando la devolución de su dinero derivado de un bien o servicio.
Contrato: A los presentes Términos de ECART PAY en el que se establecen las condiciones aplicables a la celebración de una o más operaciones y se regulan los Servicios que presta ECART PAY, mismo que deberán ser aceptados para utilizar los Servicios.
Cuenta del Usuario: La cuenta a través del cual se identifica inicialmente al Usuario, la cual requiere para que ECART PAY pueda proporcionarle sus Servicios.
Disposiciones: Las Disposiciones de Carácter General Aplicables a las Redes de Medios de Disposición.
Método de Pago: Se refiere a los Métodos de Pago que ECART PAY tiene disponibles para los Usuarios, que son: (1) Tarjetas de crédito, débito, ya sean nacionales o internacionales (VISA, MasterCard o American Express); (2) Pagos interbancarios mediante SPEI (Sistema de Pagos Electrónicos Interbancarios); (3) Pagos en efectivo a través de depósitos referenciados en las cadenas disponibles; (4) así como cualquier otro Método de Pago que esté disponible y habilitado en un futuro a través de ECART PAY.
Pasarelas de Pago: A las diferentes plataformas puestas a disposición y que podrán utilizar en su caso los Usuarios que cuenten con llaves de acceso para procesar pagos en línea.
Servicios: Significa al servicio prestado por ECART PAY, que consisten en: (1) procesamiento de solicitudes de pagos con Tarjetas a través de un sitio web o de una plataforma con conexión a internet; (2) aceptación de pagos en efectivo a través de las cadenas disponibles dentro de los Métodos de Pago de ECART PAY; (3) recibir/aceptar pagos interbancarios mediante SPEI (Sistema de Pagos Electrónicos Interbancarios).
Sitio Web y/o Plataforma: A cualquiera de los contenidos disponibles en o a través de este Sitio Web.
Tarjeta: A las tarjetas de crédito y tarjetas de débito.
Tarjetahabiente: Al titular de la Tarjeta.
Transacción: A la operación consistente en el procesamiento de toda solicitud de pago con Tarjeta sobre mercancías y/o servicios ofrecidos por el Usuario a través de alguna plataforma digital, sometiéndose dicha solicitud a la autorización o rechazo del emisor de la Tarjeta de que se trate, por conducto de ECART PAY.
Transacción Fraudulenta: a la Transacción que se realiza o se pretendan efectuar sin la autorización o consentimiento del Tarjetahabiente, o que se recibieron, procesaron y/o efectuaron sin cumplir con las disposiciones, procedimientos y/o reglas establecidas en los presentes Términos o en la legislación aplicable, o que sean ilegales, constituyan delito, sean sancionadas por la legislación aplicable o estén prohibidas conforme a la misma.
Usuario: Todas aquellas personas físicas o morales que adquieren los Servicios de ECART PAY y que cuentan con un registro de Usuario dentro del Sitio Web.
LEE ESTOS TÉRMINOS Y CONDICIONES DETENIDAMENTE ANTES DE ACCEDER O USAR LA PLATAFORMA Y LOS SERVICIOS.
COMUNICACIONES ELECTRÓNICAS
Al visitar el Sitio Web de ECART PAY o enviarnos correos electrónicos, te estás comunicando con ECART PAY electrónicamente y otorgas tu consentimiento para recibir comunicaciones electrónicas de parte de ECART PAY. ECART PAY se comunicará por medio de correo electrónico en el que te registraste en la Plataforma.
USO Y RESTRICCIONES DEL SITIO WEB DE ECART PAY
Operamos nuestro Sitio Web con la finalidad de que conozcas y puedas hacer uso de nuestros Servicios. Mediante el acceso y uso de las Plataformas, acuerdas vincularte jurídicamente por estos Términos. ECART PAY tendrá, en todo momento, el derecho de negar, restringir, suspender, condicionar el acceso y utilización a las Plataformas de manera temporal o definitiva, o bien, poner fin de inmediato a su entera discreción a estos Términos.
Para hacer uso de la Plataforma, deberás registrarte y completar el formulario correspondiente con tu información personal de manera precisa, verdadera y libre de vicios de mala fe, asumiendo el compromiso de monitorear y modificar tus datos personales cuando sea necesario, adicionalmente, verificaremos tu identidad.
Bajo el supuesto de no coincidir la información proporcionada en el registro con tu identidad, no podrás continuar con el proceso de contratación de los Servicios.
La relación entre tú y nosotros será el uso que hagas de los Servicios brindados a través del Sitio Web y/o la Plataforma digital. Al utilizar la Plataforma, declaras que actúas por cuenta propia y que el servicio será para uso personal y nunca para un tercero.
PLATAFORMA Y RESPONSABILIDADES
Estamos constantemente innovando nuestra Plataforma y Sitio Web para ofrecerte la mejor experiencia posible. Por eso, mediante estos Términos reconoces y aceptas lo siguiente:
Actualizaciones y mejoras
Nuestra plataforma puede cambiar de vez en cuando, porque estamos en constante innovación. Esto significa que algunas funciones pueden mejorar, cambiar o incluso suspenderse temporalmente. Si en algún momento suspendemos tu cuenta, no podrás entrar ni consultar tu información o movimientos.
Riesgos de usar medios digitales
Al usar la app y la web, existen riesgos que debes tener en cuenta:
Puede haber fallas de internet, retrasos en SPEI o problemas con servicios de terceros (emisores de tarjeta, adquirentes).
Si usas redes WiFi públicas o dispositivos no seguros, podrías estar en riesgo de ataques digitales.
Nosotros siempre protegemos tu información, pero también depende de ti usar la app de manera responsable.
Tu seguridad es clave
Tu usuario y contraseña son personales. No las compartas con nadie. Nunca te pediremos contraseñas o códigos por teléfono, correo o mensajes. Si notas actividades sospechosas en tu cuenta, avísanos de inmediato a través de la app o a nuestro correo de soporte.
Uso de tu página o medio web
Si tienes tu propia página integrada con nosotros, podemos mostrarla y promocionarla en otras plataformas nuestras o de nuestras empresas relacionadas. Si no quieres que lo hagamos, solo necesitas cancelar tu servicio con nosotros y dejar de usar la plataforma.
DESCRIPCIÓN DEL SERVICIO ECART PAY
ECART PAY podrá otorgarte los Servicios solicitados a través de su Plataforma digital u otras opciones de integración, y/o cualquier producto o servicio relacionado o complementario que ofrezca o pueda ofrecer en el futuro.
Procesamiento de solicitudes de pagos con Tarjetas. A los servicios de ECART PAY en su modalidad de agregador de pagos con la finalidad de procesar pagos mediante tarjetas de crédito, débito, despensa y/o monederos electrónicos por órdenes de compra a través de comercio electrónico, páginas web y aplicaciones móviles. Los servicios también podrán ser procesados mediante la modalidad de Link de Pago, que consiste en el cobro a través de un enlace web que permite a los clientes del Usuario realizar pagos por medio de los Servicios de ECART PAY previamente contratados.
Cargos recurrentes. ECART PAY podrá habilitar, a solicitud del Usuario, una modalidad adicional de procesamiento de pagos con Tarjeta bajo el esquema de cargos recurrentes. Esta funcionalidad consiste en la autorización previa otorgada por el Tarjetahabiente para que el Usuario realice cobros periódicos y automáticos a la misma Tarjeta, en los montos y periodicidad acordados entre el Usuario y el Tarjetahabiente. El Usuario se obliga a:
Obtener y conservar el consentimiento expreso e informado del Tarjetahabiente para realizar los cargos recurrentes;
Asegurarse de que el Tarjetahabiente pueda revocar en cualquier momento dicha autorización, debiendo detener los cargos de forma inmediata al recibir tal instrucción;
Informar al Tarjetahabiente sobre el calendario de cobros, el monto a ser cargado, la política de cancelación y cualquier otro elemento contractual relevante;
Cumplir con los lineamientos emitidos por ECART PAY y las marcas de tarjetas respecto a los cargos recurrentes. ECART PAY se reserva el derecho de suspender o revocar esta funcionalidad en caso de detectar niveles de contracargos, reclamaciones o prácticas incompatibles con los presentes Términos, con las Disposiciones aplicables o con los lineamientos de las Marcas de Tarjeta.
Aceptación de pagos en efectivo. A los servicios que ofrezca ECART PAY con la finalidad de procesar pagos en efectivo en moneda nacional a través de depósitos referenciados en las cadenas disponibles y/o autorizadas.
Pagos interbancarios mediante SPEI (Sistema de Pagos Electrónicos Interbancarios). A el servicio de recepción de pagos mediante transferencia SPEI (Sistemas de Pagos Electrónicos Interbancarios) a través de una cuenta CLABE única que se le asignará a cada uno de los Usuarios que decidan realizar alguna operación por este medio.
Pasarelas de Pagos con llaves personalizadas. ECART PAY podrá ofrecerte el servicio secundario de conexión a distintas “Pasarelas de Pago” en donde te brindará acceso a la Plataforma para realizar la conexión cuando estas se encuentren disponibles, esto mediante la configuración de tu sistema mediante credenciales API, con el objetivo de lograr una integración de diversas Plataformas. Para este servicio intermediario, ECART PAY no será responsable del correcto funcionamiento de las plataformas de dichas Pasarelas de Pagos.
INFORMACIÓN DEL USUARIO
Durante el tiempo que estés usando nuestro Sitio Web y/o los Servicios, se te puede solicitar que proporciones cierta información personal, de la cual ECART PAY te garantiza la protección máxima y que será únicamente empleada para el uso de la Plataforma, en la relación que se tenga con nosotros.
Utilizaremos información basada en la localización de tu dispositivo móvil, mediante tecnología GPS “Global Positioning System” (Sistema de Posicionamiento Global, por sus siglas en inglés), en aquellas ubicaciones en las que dicha tecnología esté disponible, por lo que resulta necesario recabar, utilizar, transmitir, tratar y almacenar tus datos geográficos, incluyendo, de manera enunciativa, más no limitativa, la localización geográfica del dispositivo así como la información relativa a tu nombre, apellido paterno, correo electrónico y número telefónico asociados al dispositivo. Por lo que aceptas y otorgas tu consentimiento para que llevemos a cabo la geolocalización en tiempo real para continuar con la contratación y/o utilización de los Servicios.
Asimismo, ECART PAY hace de tu conocimiento que para mayor información sobre el uso de tus datos personales y de los derechos que puedes ejercer, podrás consultar o acceder al aviso de privacidad integral en: www.ecartpay.com
REGISTRO DE CUENTA
Si deseas utilizar nuestros Servicios deberás registrarte aceptando los presentes Términos. Para registrarse es obligatorio completar el formulario de identificación en todos los campos con datos válidos e información personal exacta, precisa y verdadera.
Al registrarte, garantizas la veracidad de la información y asumes el compromiso de actualizar tus datos personales cuando ECART PAY así lo requiera, conforme resulte necesario.
Nos reservamos el derecho de solicitar comprobantes y/o información adicional a efectos de validar y corroborar la información entregada, así como de suspender temporal o definitivamente a aquellos Usuarios cuyos datos no hayan podido ser confirmados.
Asimismo, ECART PAY, con el objetivo de cumplir con la regulación aplicable en materia de prevención de lavado de dinero y financiamiento del terrorismo (PLD/FT) y sus políticas internas al respecto, podremos solicitarte determinada información y/o documentación con fines identificatorios, de conocimiento y monitoreo transaccional, que podrá variar, de acuerdo con tu actividad económica dentro de la Plataforma de los Servicios que utilices.
Nos reservamos el derecho de rechazar una solicitud de registro o de cancelar o suspender, temporal o definitivamente una cuenta, de presentarse los siguientes supuestos: a) en caso de detectar incongruencias o inconsistencias en la información provista; b) en caso que no proporciones o no actualices en tiempo y forma la información y/o documentación que haya sido requerida, sin que tal decisión genere derechos de indemnización o resarcimiento; c) en caso de que la actividad que hayas declarado se encuentre definida como prohibida de conformidad con los presentes Términos.
No podrás registrarte con nosotros en caso de que tengas o hayas tenido sanciones relacionadas a cualquier situación delictiva, que tu nombre se encuentre en listas negras y/o, tengas o hayas tenido cualquier relación con algún tipo de fraude, independientemente de que este haya sido sancionado o no.
Con carácter general, el acceso al Sitio Web podrá ser libre. No obstante, ECART PAY condiciona el acceso a determinadas áreas del Sitio Web y la utilización de todos sus Servicios al previo cumplimiento del formulario de registro de identificación de los Usuarios correspondiente.
ECART PAY podrá poner a disposición determinados Servicios cuya utilización pudiera requerir registros complementarios y/o la satisfacción de determinadas contraprestaciones. En su caso, dicho registro se efectuará en la forma expresamente indicada en el propio servicio o en las condiciones particulares que lo regulen.
Una vez se complete satisfactoriamente el proceso de registro, realizaremos la activación de la cuenta. El uso de tu cuenta es personal e intransferible, por lo que aceptas que, en todo momento, serás el único responsable por todos los movimientos efectuados en tu cuenta y de mantener en resguardo la contraseña con la cual tendrás acceso a la Plataforma.
Te obligas a notificar a ECART PAY en forma inmediata y por el medio idóneo y fehaciente, cualquier uso no autorizado de tu cuenta, así como el acceso por terceros no autorizados a la misma.
ECART PAY, se reserva el derecho de rechazar cualquier solicitud de registro o de cancelar un registro previamente aceptado, sin que esté obligado a comunicar o exponer las razones de su decisión y sin que ello genere algún derecho a indemnización o resarcimiento.
Confirmas que tienes la capacidad suficiente y legal para adherirte a los presentes Términos.
Si llegases a proporcionar información falsa, inexacta, desactualizada y/o incompleta, o bien, si ECART PAY tiene motivos razonables para sospechar que has violado los presentes Términos, ECART PAY tiene el derecho de suspender o cancelar tu cuenta y negar el uso, presente o futuro, de los Servicios o cualquier parte de estos.
CONDICIONES GENERALES DE LOS SERVICIOS
ECART PAY y tú convienen en que los presentes Términos tienen por objeto establecer las condiciones de uso del(los) Servicio(s) anteriormente indicados a través de todos los Métodos de Pago que estén disponibles o vayan a estar disponibles en la Plataforma.
Al utilizar cualquiera de los Servicios, asumes todos los riesgos que conlleva la operación y realización de actividades a través de sitios web o internet.
Para el procesamiento de solicitudes de pago con Tarjeta, te comprometes a no aplicar ningún cargo adicional a tus clientes por aceptar pagos con Tarjetas y/o acreditaciones de fondos a través de tu(s) plataformas y/o de la Plataforma de ECART PAY.
Disponibilidad y plazos para la liquidación de tus fondos
Los fondos que se acrediten en tu cuenta por motivo de los Servicios contratados quedarán disponibles de acuerdo con los siguientes plazos y condiciones:
El importe de las Transacciones autorizadas en un día específico de operación y antes de la hora de corte (22:00 horas), horario del Centro de México, para Tarjetas VISA y MasterCard, se depositarán en tu cuenta bancaria dentro de los 2 (dos) días hábiles siguientes a autorización de la transacción correspondiente.
Para el caso de Transacciones con Tarjetas American Express, se te depositarán dentro de 2 (dos) a 3 (tres) días hábiles siguientes a la autorización de la transacción correspondiente.El importe de las Transacciones por transferencias interbancarias y pagos en efectivo que sean recibidos de lunes a domingo serán depositados el jueves de la siguiente semana.
En este acto, reconoces que eres responsable de cualquier cantidad adeudada a ECART PAY que se derive de los Servicios, incluyendo la realización o procesamiento de Transacciones.
Limitaciones
Aceptas y reconoces que ECART PAY podrá determinar un importe máximo para tus Transacciones, monto que podrá variar de acuerdo con el Método de Pago, tipo de solicitud y/o a criterio de ECART PAY e incluso podrá ser modificado en cualquier momento siendo suficiente su publicación en la Plataforma.
Adicionalmente, te informamos que las entidades financieras o bancos adquirentes podrán establecer montos mínimos y máximos por ciertas transacciones, los cuales podrán cambiar de tiempo en tiempo.
Contracargos
ECART PAY te notificará cuando exista un Contracargo, en tal caso, te comprometes a brindar a ECART PAY, dentro de los 5 (cinco) días naturales posteriores a la notificación, la información que se te solicite de las operaciones y sus reversiones generadas, bajo los recursos y medios técnicos que ECART PAY ponga a tu disposición y, autorizas a ECART PAY para utilizar esta información a fin de apoyarte a desvirtuar dicho Contracargo.
Manifiestas estar informado y autorizas a ECART PAY para realizar retenciones a tus fondos cuando se reciban Contracargos por Transacciones y/o por operaciones realizadas con Tarjetas bancarias, hasta por 180 (ciento ochenta) días naturales, tratándose de Tarjetas y/o Transacciones internacionales la retención podrá ser hasta por 540 (quinientos cuarenta) días naturales.
Una vez recibida la información correspondiente, Ecart Pay entregará la información al Banco emisor dentro del plazo que se le haya indicado. El Banco emisor analizará y dará una resolución sobre el Contracargo en un plazo no mayor a 45 días hábiles después de la entrega de la información. El Banco emisor notificará a ECART PAY sobre dicha resolución, la cual podrá ser a favor del Tarjetahabiente o a favor del Comercio (tú).
Si la resolución fue a favor del Tarjetahabiente, ECART PAY reembolsará el monto de la transacción directamente al Tarjetahabiente o a través del Banco emisor. Si la resolución fue a favor del Comercio, esto quiere decir que se resolvió a tu favor, por lo que ECART PAY liberará la retención anteriormente realizada y se te liquidará la transacción.
Es importante señalar que la decisión de la resolución del Contracargo depende completamente del Banco emisor, por tal motivo, ECART PAY no se hace responsable del resultado de la resolución de los Contracargos.
En caso de que ECART PAY no reciba la información solicitada o el envío sea incompleto, erróneo, deficiente y/o demorado, la retención realizada por el monto de los Contracargos será descontada de la liquidación de tus fondos.
Sin perjuicio de lo detallado en esta sección, se informa que, en el caso que no tuvieras fondos a liquidar, te comprometes a pagar los Contracargos dentro de los 30 (treinta) días naturales posteriores a la notificación a la cuenta bancaria que ECART PAY te proporcionará para tal propósito.
ECART PAY se reserva el derecho de retener para investigación aquellos pagos que considere, a su entera discreción, sean o pudieran ser operaciones irregulares o con riesgo de Contracargo.
Adicional al párrafo que antecede, ECART PAY podrá retener por un riesgo detectado cierto porcentaje de la liquidación de tus fondos hasta por un periodo que podría ser de al menos de 30 días naturales, para este caso, ECART PAY te dará previo aviso.
Responsabilidad por los Fondos
El Usuario exime de toda responsabilidad a ECART PAY por situaciones que pudieran afectar a las entidades bancarias, financieras y/o agentes donde estén depositados los fondos de las cuentas, así como por situaciones políticas y económicas que pudieran presentarse en el país, y que sean ajenas a ECART PAY.
En los casos mencionados, los Usuarios no podrán imputar responsabilidad alguna a ECART PAY, sus filiales o subsidiarias, empresas controlantes y/o controladas, ni exigir el reintegro del dinero o pago por lucro cesante, en virtud de perjuicios resultantes de este tipo de situaciones ni por órdenes de pago no procesadas o rechazadas por el sistema, ni por cuentas suspendidas o canceladas.
Aceptas y te obligas a mantener a ECART PAY a salvo por cualquier reclamo que exista por parte de un tercero relativo a las relaciones contractuales que adquieran contigo y los pagos que efectúen mediante los Servicios.
Aclaraciones
Cuando no estés de acuerdo con algún movimiento que aparezca en el Estado de Cuenta respectivo o en el estado de movimientos disponible en la Plataforma, podrás presentar una solicitud de aclaración a ECART PAY dentro de un plazo de 30 (treinta) días hábiles contados a partir de la fecha en que se realizó dicho movimiento.
Dicha solicitud de aclaración podrá realizarse a través del portal de ayuda de la Plataforma; los canales electrónicos de ayuda que ponga a su disposición ECART PAY y/o mediante el correo electrónico support@ecartpay.com
Una vez recibida tu solicitud de aclaración, ECART PAY tendrá la obligación de acusar de recibido e indicar el número de folio de atención de tu aclaración. ECART PAY contará con un plazo máximo de 45 (cuarenta y cinco) días naturales o de 180 (ciento ochenta) días naturales cuando se trate de operaciones realizadas en el extranjero, para entregarte el dictamen correspondiente, anexando al mismo copia simple del documento o evidencia considerada para la emisión de dicho dictamen, así como un informe detallado en el que se respondan todos los hechos contenidos en la solicitud presentada.
Si transcurre el plazo de 30 (treinta) días hábiles mencionado en el primer párrafo de esta sección sin que hayas efectuado alguna aclaración, se entenderá que estás de acuerdo con las operaciones efectuadas y que los asientos o conceptos que aparecen en tus estados de cuenta, y que figuren en la contabilidad de ECART PAY se tendrán aceptados por tu parte y harán prueba plena.
Devoluciones y/o cancelaciones
Autorizas a ECART PAY a disminuir el total del valor de las Transacciones a depositar el importe correspondiente cuando se presenten devoluciones y/o cancelaciones y que estas cantidades sean depositadas a la Tarjeta de la cual se realizó dicho cargo. Solo se podrán efectuar las devoluciones o cancelaciones por el importe total cargado a la Tarjeta.
Eres responsable de informar adecuadamente a tus clientes, al momento de la Transacción, de cualquier limitación que tengas para aceptar la devolución de mercancías y, en su caso, procurarás ofrecer reembolsos contra recibo de la Transacción realizada a la cuenta del Tarjetahabiente a la que se haya cargado la Transacción y procurarás entregar un comprobante de la operación.
ECART PAY no realizará el reembolso de las comisiones generadas por las Transacciones realizadas.
COMISIONES POR EL SERVICIO
Por la utilización de los Servicios, te obligas a pagar a ECART PAY la(s) comisión(es) que se genere(n) más el impuesto al valor agregado que resulte correspondiente por cada operación y/o Transacción.
Manifiestas expresamente que comprendes y estás de acuerdo en los términos, condiciones, cantidades y alcance de las comisiones que estás obligado a cubrir, de tal forma, autorizas expresamente para que descontemos con cargo a cualesquiera cantidades que debamos entregarte, el monto de la comisión (o cualquier otro impuesto o derecho que de conformidad con la legislación aplicable deba retener).
ECART PAY podrá modificar unilateralmente las comisiones notificando con 30 (treinta) días naturales previo a la fecha en que surtan efectos. En caso de que no estuvieras de acuerdo con dicho cambio, podrás dar por terminada la relación contractual sin responsabilidad alguna, mediante aviso con al menos 10 (diez) días de anticipación a la fecha en que surta efectos el cambio de comisiones.
SERVICIO DE GESTIÓN DE PAGO
Del Pago
ECART PAY en su caso, podrá poner a tu disposición el servicio secundario de gestión de pagos de acuerdo con las instrucciones que nos des, a fin de liquidar tus fondos por cuenta y orden tuya, utilizando la Plataforma brindada por ECART PAY.
Se acuerda que las solicitudes de gestión o procesamiento de solicitudes de pago que oportunamente completes se regirán por estos Términos generales.
Al completar una solicitud de gestión de pago, otorgas un mandato irrevocable a ECART PAY para pagar, por tu cuenta y orden, una determinada suma de dinero en relación con la cual se complete la solicitud de gestión de pago, por tu cuenta y orden, sujeto a los Términos del servicio de gestión de pago.
ECART PAY no utilizará los fondos para fines distintos a los instruidos por parte tuya.
ECART PAY se reserva el derecho de no procesar aquellas solicitudes de gestión de pago que estén incompletas o en las cuales haya discrepancias entre los datos provistos por tu parte y los datos ingresados efectivamente a ECART PAY o bien, porque ECART PAY lo considere necesario, sin necesidad de justificar su decisión.
ECART PAY no verificará la causa u obligación que originó la instrucción de pago, ni las demás circunstancias relativas a la instrucción de pago.
En virtud de que ECART PAY es ajeno a la obligación que dio origen a la solicitud de gestión de pago, ECART PAY no será responsable ni verificará las causas, importe o cualquier otra circunstancia relativa a dicha solicitud, así como respecto de la existencia, calidad, cantidad, funcionamiento, estado, integridad o legitimidad de los bienes o Servicios que hayas ofrecido, adquirido o enajenado y pagado utilizando ECART PAY.
Las instrucciones de pago introducidas en una solicitud de gestión de pagos sólo podrán efectuarse a través de la Plataforma y ninguna instrucción cursada será procesada ni reputada válida por otros medios ajenos a la Plataforma.
ECART PAY no será responsable por órdenes, instrucciones, solicitudes de gestión de pago y/o pagos equivocados o incompletos causados por la introducción errónea de la información que nos proporciones.
ECART PAY no será responsable ni garantizará el cumplimiento de las obligaciones que hubieses asumido con terceros en relación con los pagos a efectuar o cobrar a través de la Plataforma.
MATERIAL PATRIMONIAL
A menos que se solicite específicamente, no solicitamos ni deseamos recibir ninguna información confidencial, secreta o patrimonial, ni otro material tuyo a través del Sitio Web, por correo electrónico o por cualquier otro medio.
Cualquier información, trabajos creativos, demostración, ideas, sugerencias, conceptos, métodos, sistemas, diseños, planes, técnicas u otros materiales que nos hayas mandado o presentado (incluyendo, por ejemplo, sin limitar, aquello que presentes o envíes a nuestros grupos de chateo, tablas de mensajes y/o nuestros blogs, o que nos mandes vía correo electrónico) se considerará como no confidencial o secreto y que puede ser usado por nosotros de cualquier manera consistente con el Sitio Web.
Al presentar o mandarnos materiales, tu; I. Manifiestas la legitimidad de los materiales presentados, que ninguna otra persona tiene ningún derecho sobre ellos, y que cualquier “derecho moral” sobre los materiales presentados ha sido renunciado; II. No nos concedes a nosotros o a nuestros afiliados, derechos y licencias libres de regalías, sin restricciones, mundiales, irrevocables, no exclusivos y totalmente transferibles, que pueden ser cedidos y sublicenciados, para usar, copiar, reproducir, modificar, adaptar, publicar, traducir, crear trabajos derivados de, distribuir, ejecutar, exponer e incorporar en otros trabajos cualquiera de los materiales presentados en cualquier forma, medio o tecnología no conocida o por desarrollar, incluyendo propósitos promocionales y/o comerciales.
No podemos ser responsables de conservar ningún material proporcionado por ti y podemos borrar o destruir dicho material presentado en cualquier momento.
DERECHOS DE PROPIEDAD
ECART PAY es el propietario exclusivo de todos los derechos, título e intereses en y del Sitio Web de todo el contenido (incluyendo por ejemplo, audios, fotografías, ilustraciones, gráficos, otros medios visuales, videos, copias, textos, software), códigos, datos y materiales del mismo, el aspecto y el ambiente, el diseño y la organización del Sitio Web y la compilación de los contenidos, códigos, datos y los materiales en el mismo, incluyendo, pero no limitando, a cualesquiera derechos de autor, derechos de marca, derechos de patente, derechos de base de datos, derechos morales, derechos sui generis, y otras propiedades intelectuales y derechos patrimoniales del mismo.
Tu uso al Sitio Web no te otorga propiedad de ninguno de los contenidos, códigos, datos o materiales a los que puedas acceder en o a través del Sitio Web.

USO PROHIBIDO
Cualquier distribución, publicación o explotación comercial o promocional del Sitio Web o de cualquiera de los contenidos, códigos, datos o materiales en el Sitio Web, está estrictamente prohibida, a menos de que hayas recibido el previo permiso por escrito del personal autorizado de ECART PAY, o de algún otro poseedor de derechos aplicables.
A no ser como está expresamente permitido en los presentes Términos, no puedes descargar, informar, exponer, publicar, copiar, reproducir, distribuir, transmitir, modificar, ejecutar, difundir, transferir, crear trabajos derivados de, vender o de cualquier otra manera explotar cualquiera de los contenidos, códigos, datos o materiales en o disponibles a través del Sitio Web.
Te obligas, además, a no alterar, editar, borrar, quitar o de otra manera cambiar el significado o la apariencia de, o cambiar el propósito de cualquiera de los contenidos, códigos, datos o materiales en o disponibles a través del Sitio Web, incluyendo, sin limitación, la alteración o retiro de cualquier marca comercial, marca registrada, logo, marca de Servicios o cualquier otro contenido de propiedad o notificación de derechos de propiedad.
Reconoces que no adquieres ningún derecho de propiedad al descargar algún material con derechos de autor o de a través del Sitio Web.
Si haces otro uso de la Plataforma o de los contenidos, códigos, datos o materiales que ahí se encuentren o que estén disponibles a través de ésta, a no ser como se ha estipulado anteriormente, puedes omitir las leyes de derechos de autor y otras leyes de los Estados Unidos Mexicanos y de otros países, así como otras leyes aplicables y puedes ser sujeto a responsabilidad legal por dicho uso no autorizado.
MARCAS COMERCIALES
Las marcas comerciales, logos, marcas de Servicios, marcas registradas (en adelante “Marcas Comerciales”) expuestas en el Sitio Web o en los contenidos disponibles a través del Sitio Web, son marcas comerciales de ECART PAY registradas, no registradas y otras y, no pueden ser usadas con respecto a productos y/o Servicios que no estén relacionados, asociados o patrocinados por sus poseedores de derechos y que puedan causar confusión a los clientes o de alguna manera que denigre o desacredite a sus poseedores de derechos.
Nada de este contenido en el Sitio Web deberá ser interpretado como otorgado, por implicación, desestimación o de otra manera, alguna licencia o derecho para usar alguna marca comercial expuesta del Sitio Web sin el permiso escrito de ECART PAY o de terceros que puedan ser dueños de dicha marca comercial.
El mal uso de las marcas comerciales expuestas en el Sitio Web o a través de o en cualquiera de los Servicios del Sitio Web está estrictamente prohibido.
NOTIFICACIONES
Para efectos de practicar oportunas notificaciones, ECART PAY designa como domicilio de contacto el estipulado al inicio de los presentes Términos. El correo electrónico facilitado por tu parte durante el proceso de registro en el Sitio Web será el utilizado por ECART PAY a efectos de practicarte notificaciones desde el momento de la contratación.
Será tu obligación mantener debidamente actualizados tus datos que, a efectos de notificaciones, se referencian en la presente sección.
Todas las notificaciones que te efectúe ECART PAY se considerarán válidamente efectuadas si se han realizado empleando los datos correctos y precisos, a través de los medios anteriormente señalados.
ECART PAY y sus sociedades relacionadas no serán responsables por las conductas de tu parte que originen o vinculen con información contenida en correos electrónicos falsos o que aparenten provenir de ECART PAY que sean enviados por terceros sin relación con ECART PAY ni sus sociedades relacionadas; así como tampoco responderán por las consecuencias dañosas de tales conductas, ni por la circulación de los mencionados correos electrónicos falsos.
LEY APLICABLE
Al visitar ECART PAY, aceptas que las leyes de los Estados Unidos Mexicanos, independientemente de tu domicilio y los conflictos de leyes, regirán estos Términos, así como cualquier controversia de cualquier tipo que pudiera surgir entre ECART PAY y/o sus filiales o subsidiarias y tú.
CONTROVERSIAS
Cualquier controversia relacionada de cualquier manera con tu visita a ECART PAY, será sometida a los métodos alternos de solución de controversias, con la excepción de que, en la medida en que tú, de cualquier forma, hayas violado o amenazado con violar los derechos de propiedad intelectual de ECART PAY, este último podrá solicitar medidas cautelares u otro tipo de reparación ante el tribunal Estatal o Federal en el Estado de Nuevo León y, acuerdas someterte a la jurisdicción y sede exclusiva de dichos tribunales.
POLÍTICAS, MODIFICACIÓN Y DIVISIBILIDAD DEL SITIO WEB
Es necesario que revises nuestras políticas publicadas en este Sitio Web. Estas políticas también regirán tu visita a cualquier Plataforma en relación con ECART PAY. Nos reservamos el derecho de hacer cambios a nuestro Sitio Web, políticas y a estos Términos en cualquier momento.
En caso de que alguna de las estipulaciones resultara ser inválida, nula o por cualquier razón inaplicable, tal condición se considerará separada de la validez y aplicabilidad de alguna de las demás condiciones.

Estás de acuerdo en recibir campañas de correo electrónico/newsletter con el fin de brindarte información sobre promociones, nuevas funcionalidades, avisos importantes e información general.
TERMS AND CONDITIONS MSI
The payment method Installments Without Interest (hereinafter referred to as "MSI") is an additional functionality integrated into the card payment processing service provided by Ecart Pay, through which Ecart Pay Users (hereinafter referred to as "User") can offer their own customers (hereinafter referred to as "User's Customers" or "Cardholder") the option to defer the payment of the amount of their purchases or expenses made with a credit card, in fixed monthly payments without generating interest, in accordance with the terms and conditions established by the participating issuing banks (hereinafter referred to as "Participating Banks").
NATURE OF THE SERVICE
The MSI constitutes a financing facility provided by the Participating Banks and technically enabled through the Ecart Pay processing system. Through this option, the Cardholder can select terms of 3, 6, 9, 12, or 18 months without interest, as long as the minimum amounts established for each term are met. The User, for its part, receives from Ecart Pay the total transaction amount in one single transaction, deducting the base commission for card usage and the applicable surcharge for the selected MSI period. The monthly charge to the Cardholders will be made directly by the Issuing Bank, according to the chosen term.
MINIMUM AMOUNTS PER TERM
To make use of the MSI service, the transactions must comply with the following minimum amounts, determined by the number of monthly installments:
RESTRICTIONS
This service is limited to use with personal credit cards issued by Participating Banks. It does not apply to transactions made with:
Debit cards.
Business cards.
Private or non-bank cards (Non-Participating Banks).
Cards issued outside of Mexican territory.
Participating Banks may modify, without prior notice, eligibility criteria, authorized BINs, or participating products. Ecart Pay does not guarantee acceptance of the MSI option by the Issuing Bank, even if the transaction meets the minimum requirements. Any transaction that does not meet the above conditions will not be eligible for payment in Months Without Interest.
PARTICIPATING BANKS
The following are the authorized Participating Banks for the MSI service at the time of publication of these Terms and Conditions: Afirme, Banco Azteca, BanBajio, Banjercito, Banregio, Banorte, Caja Morelia Valladolid, Crediclub, Falabella, Hey Banco, HSBC, Inbursa, Invex Banco, Konfío, Liverpool Visa, Mifel, Banco Multiva, RappiCard, Santander, Scotiabank, Suburbia Visa.
This list may be modified at any time by issuers, acquirers, or Ecart Pay without prior notice. The effective participation of each bank will depend on its internal policies and current configuration of the service.
USER SETTLEMENT PROCESS
Once a transaction has been made under the MSI scheme:
The Cardholder will be charged monthly by their Issuing Bank according to the selected term.
The User will receive from Ecart Pay the total amount of the sale in a single payment, deducting:
The standard processing fee.
The corresponding surcharge for the selected MSI term.
The distribution will be made according to the times and mechanisms defined by Ecart Pay in its settlement policies.
Consult the costs derived from this option directly with your Ecart Pay advisor, as they may vary according to the selected term and current commercial conditions.
ONCE YOU HAVE READ THESE TERMS, YOU ACCEPT THE TRUTH AND LEGITIMACY OF THEM AND THE GUIDELINES UNDER WHICH THE COMMERCIAL RELATIONSHIP WILL BE GOVERNED.

TÉRMINOS Y CONDICIONES DEL SERVICIO DE DOMICILIACIÓN BANCARIA
Los presentes términos y condiciones regulan el uso del Servicio de Domiciliación Bancaria (el “Servicio”) que Ecart Pay pone a disposición de sus comercios afiliados (el “Afiliado”).
OBJETO DEL SERVICIO
Ecart Pay proporciona al Afiliado una infraestructura tecnológica y operativa que le permite instruir cargos domiciliados a cuentas bancarias de sus clientes finales (los “Clientes”), actuando exclusivamente como procesador e intermediario de pagos.
Ecart Pay no presta, no comercializa ni garantiza los servicios o productos ofrecidos por el Afiliado. La relación comercial respecto del servicio ofrecido al Cliente existe únicamente entre el Cliente y el Afiliado.
AUTORIZACIÓN DEL CLIENTE FINAL
El Afiliado se obliga a obtener del Cliente una autorización expresa, previa e informada para la domiciliación bancaria e informar de forma clara y suficiente el monto, la periodicidad, la vigencia, las condiciones de cancelación y conservar evidencia suficiente del mandato otorgado por el Cliente.
El Afiliado reconoce que Ecart Pay no es responsable de la inexistencia, deficiencia o invalidez de la autorización otorgada por el Cliente. El Afiliado mantendrá disponible dicha evidencia durante todo el tiempo de vigencia del Servicio y por el plazo adicional que exijan disposiciones legales aplicables, obligándose a proporcionarla a Ecart Pay cuando ésta lo requiera.
MANDATO Y EVIDENCIA ELECTRÓNICA
El Afiliado acepta y reconoce que las autorizaciones otorgadas por medios electrónicos constituyen mandatos válidos, Ecart Pay podrá almacenar, resguardar y conservar la evidencia correspondiente, dicha información podrá ser utilizada ante instituciones bancarias, autoridades competentes, procesos de aclaración, reclamación o controversia. El Afiliado autoriza a Ecart Pay a tratar dicha información únicamente para fines operativos, de validación, cumplimiento legal y prevención de fraudes.
EJECUCIÓN DE CARGOS Y REINTENTOS
En caso de que un cargo domiciliado no sea exitoso por causas tales como falta de fondos, cuenta bancaria bloqueada, rechazo por parte de la institución bancaria, el Afiliado autoriza expresamente a Ecart Pay a realizar uno o varios intentos de cobro, incluyendo cargos parciales o totales en días distintos, hasta cubrir el importe instruido, sin necesidad de aviso o notificación adicional. El Afiliado será el responsable de verificar que las instrucciones proporcionadas sean correctas, completas y vigentes.
REVERSIONES, RECLAMACIONES Y CONTRACARGOS
El Afiliado reconoce y acepta que toda reclamación o inconformidad del Cliente final será responsabilidad exclusiva del Afiliado. Los cargos revertidos, rechazados o desconocidos serán debitados automáticamente de su saldo o cuenta de liquidación conforme a los términos y condiciones generales de Ecart Pay.
CANCELACIÓN Y MODIFICACIÓN DEL SERVICIO
El Afiliado será el único responsable de gestionar con sus Clientes cualquier cancelación, modificación o aclaración relacionada con el servicio ofrecido. Ecart Pay podrá suspender o detener cargos por instrucción bancaria, regulatoria o legal.
Ecart Pay podrá cancelar o suspender el Servicio de forma inmediata en caso de:
Incumplimiento a los presentes términos.
Riesgo operativo, legal o reputacional.
Niveles elevados de reclamaciones o contracargos.
Uso indebido o irregular del Servicio.
Incumplimiento a normativa aplicable o políticas internas de Ecart Pay.
LIMITACIÓN DE RESPONSABILIDAD
La responsabilidad de Ecart Pay se limita exclusivamente al correcto procesamiento técnico de los cargos conforme a las instrucciones recibidas del Afiliado. Ecart Pay no será responsable por pérdidas, daños indirectos, lucro cesante, fallas bancarias, indisponibilidad del sistema financiero, errores en la información proporcionada por el Afiliado o causas de fuerza mayor.
PROTECCIÓN DE DATOS
El Afiliado se obliga a cumplir con la normativa aplicable en materia de protección de datos personales, declarando que cuenta con el consentimiento válido de los Clientes para compartir la información necesaria con Ecart Pay para la prestación del servicio. Los datos serán tratados conforme al Aviso de Privacidad de Ecart Pay.
El Servicio se considerará aceptado y activo a partir de que el Afiliado haga uso del Servicio de domiciliación bancaria. El uso continuado del Servicio implica la aceptación de modificaciones futuras a estos términos cuando sean publicadas por Ecart Pay.
UNA VEZ LEÍDOS LOS PRESENTES TÉRMINOS, ACEPTAS LA VERACIDAD Y LEGITIMACIÓN DE ESTOS Y LOS LINEAMIENTOS POR LOS CUALES SERÁ REGIDA LA RELACIÓN COMERCIAL.
